Welcome to Texas Pickleball. These Terms & Conditions govern your use of https://txpklball.com/, your membership, and all related services. By accessing or using our Site or purchasing a membership, you agree to these Terms.
If you do not agree, please do not use our Site or Services.
1. Memberships & Services
- We offer various membership plans (Basic, Premium, Family, and others as listed on the Site). Pricing and benefits are described on the Site and may be updated from time to time.
- Memberships are personal and non-transferable unless otherwise stated.
- Memberships may be billed monthly, annually, or as otherwise specified at checkout.
- Promotional offers (including “early bird” discounts) are subject to eligibility and time limits.
2. Reservations & Court Usage
- Court reservations must be made through our booking system (when live).
- Reservations are subject to availability and may have limits on frequency or duration.
- Members and guests are expected to respect the facility, staff, and other players.
- We reserve the right to cancel or reschedule reservations due to maintenance, events, or unforeseen circumstances.
3. Payments & Billing
- Membership fees and other charges must be paid in full at the time of signup or renewal.
- Payments are processed through third-party payment processors. We do not store your full payment details.
- If a payment fails, we may suspend or terminate your membership until payment is received.
- Fees are generally non-refundable except as required by law or explicitly stated in a promotion.
4. Cancellations & Refunds
- You may cancel your membership at any time via your account or by contacting us.
- Cancellation will stop future billing but does not automatically entitle you to a refund for any unused portion unless required by law.
- We may provide prorated refunds in special cases (e.g., facility closure for extended periods).
5. Conduct & Responsibilities
- You agree to use the facility safely and respectfully.
- No abusive, unlawful, or disruptive behavior is permitted.
- Proper attire and footwear are required on courts.
- You are responsible for the conduct of any guests you bring.
6. Health & Liability Disclaimer
- Participation in pickleball and related activities involves physical exertion and risk of injury.
- By using our facility or participating in events, you acknowledge these risks and agree to participate at your own risk.
- To the maximum extent permitted by law, we are not liable for injuries, accidents, or loss/damage to personal property while using our services.
- We strongly recommend consulting a physician before beginning any new exercise or sports program.
7. Facility Rules & Changes
- We may establish additional rules for court usage, classes, tournaments, and events.
- We reserve the right to update membership benefits, services, or facility hours at any time.
8. Termination of Membership
We may suspend or terminate your membership, with or without notice, if you:
- Violate these Terms or facility rules,
- Fail to pay fees, or
- Engage in conduct harmful to others or our facility.
If terminated for cause, you are not entitled to a refund.
9. Intellectual Property
All content on the Site, including text, images, logos, and materials, are the property of Texas Pickleball or licensed to us. You may not copy, reproduce, or distribute without permission.
10. Third-Party Links
The Site may contain links to third-party websites (including social media, payment processors, or external booking systems). We are not responsible for their content or practices.
11. Disclaimers & Limitation of Liability
- The Site and Services are provided “as is” without warranties of any kind.
- To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages.
- Our total liability to you will not exceed the amount you paid for your membership in the 12 months prior to the claim.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, United States.
Any disputes shall be resolved in the courts located in Denton County, Texas, unless otherwise required by law.
13. Changes to Terms
We may update these Terms at any time. Updates will be posted on the Site with a revised “Effective Date.” Continued use of the Site or Services after updates means you accept the new Terms.
